The general conditions of sale to which ConTe' refers are indicated below.

1. Subject
These general terms and conditions of sale (hereinafter the "General Terms and Conditions") are applicable to all sales of products (hereinafter the "Products" or "Product") concluded remotely through the website www.contescarpemoda.it (hereinafter the "Website").
The language available to conclude the contract through the Website is the Italian language. The Customer is required to carefully read the General Conditions made available on the Website, in order to allow their knowledge, storage and reproduction, pursuant to Article 12, paragraph 3, of Legislative Decree 9 April 2003, no. 70 ("Implementation of Directive 2000/31/EC, hereinafter, the "Ecommerce Decree"). All contracts concluded through the Website are governed by these General Terms and Conditions and by the Italian law, in particular by Legislative Decree no. 206 of 6 September 2005 (hereinafter the "Consumer Code") by the Legislative Decree no. 21 of 21 February 2014, with specific reference to the regulations on distance contracts and by the Legislative Decree no. 70 of 9 April 2003 on certain aspects concerning e-commerce (hereinafter the "Ecommerce Decree").
The language available to conclude the contract through the Website is the Italian language. 3. Product information and availability
The information relating to the Products, with the relevant product codes, is detailed on the Website. The essential characteristics of the products are presented on each product sheet.
The graphic representation of the Products proposed on the Website, as well as the images and colours correspond to the photographic image of the Products themselves and have the sole purpose of presenting them for sale, without any guarantee or commitment by Biella Scarpe spa regarding the exact correspondence between the image depicted on the Website and the actual Product. This applies in particular to colour aspects, which may not correspond to the actual colours, also due to the Internet browser or monitor used. All Products are subject to availability at the time. Biella Scarpe spa reserves the right to change the limits to the quantity and/or type of Products that can be purchased on-line on the Website at any time.
The style, models and colours of the Products described on the Site may be changed without notice. During the procedure for the conclusion of the contract, the Customer will be informed of the impossibility of proceeding with the order due to the unavailability of the Product ordered.

The prices of the Products are expressed on the Website in Euros/Pounds and are inclusive of all applicable taxes or duties. The shipping costs shown separately on the order form must be added to the prices of the Products.
Prices may be subject to updates, therefore the Customer must ascertain the final sale price before placing the relative order. Biella Scarpe spa constantly verifies that all the prices indicated on the Website are correct, without however guaranteeing the absence of errors. In case of discounts/promotions, the discount percentage is subject to rounding to the nearest whole number.

5. Conclusion of the contract
The information contained in the Website does not constitute an offer by Biella Scarpe spa. The publication of the Products displayed on the Website constitutes an invitation to the Customer to formulate a contractual proposal of purchase.
The order sent by the Customer has the value of a contractual proposal and implies the full knowledge and acceptance of these General Conditions.
The Customer can purchase the Products present in the electronic catalogue of Biella Scarpe spa, illustrated in detail on the Website within the respective sections by product category, respecting the technical access procedures illustrated therein.
Precisely, in order to conclude the contract, it is necessary to fill in the order form in electronic format and send it to Biella Scarpe spa, electronically, following the relevant instructions.
The order form contains a reference to the General Terms and Conditions of Sale and to the information on the right of withdrawal, as well as a summary of information on the essential characteristics of each product ordered and its price (including all applicable taxes and duties), the means of payment and the method of delivery of the products purchased, the shipping costs, the conditions for exercising the right of withdrawal and the method and time required to return the products.
Before sending an order proposal, you will be asked to carefully read the General Terms and Conditions of Sale, as they will be binding once the contract has been concluded, as well as the Right of Withdrawal Notice, and to print or keep a copy of them.
If the Customer needs to correct any errors in data entry, they must follow the appropriate modification procedure indicated on the Website before submitting their order proposal.
The correct receipt of the Customer's proposal is confirmed by Biella Scarpe spa through an automatic reply sent to the e-mail address communicated by the Customer and only confirms the correct receipt of the proposal within the information systems.
This confirmation message shall indicate an "Order Number", to be used in any subsequent communication with Biella Scarpe spa.
In addition to the information required by law, the message will include all the data entered by the Customer, who undertakes to check that they are correct and to promptly notify any corrections.
Any additional costs incurred as a result of mistakes in the data not reported in time shall be borne exclusively by the Customer.
Each order can be viewed by the Customer on the Website, in their personal area, immediately after placing the order.
The contract stipulated between Biella Scarpe spa and the Customer shall be considered concluded when the Customer receives confirmation from Biella Scarpe spa that his order proposal, sent in compliance with the purchase procedure indicated on the Website, has been successful.
Confirmation of the order is given to the Customer when the Products are handed over to the carrier for shipment.
Biella Scarpe spa has the right to accept or not, at its own discretion, the order sent by the Customer, without the latter being able to make claims or request their rights of any kind, for any reason, including compensation, in case of non-acceptance of the order itself.
In particular, Biella Scarpe spa reserves the right not to accept purchase proposals and to cancel orders that do not provide sufficient guarantees of solvency or if - also following a comparison with the circuit that manages credit card payments - anomalies are found in the transactions and means of payment used by the Customer.
In such cases, the order proposal sent by the Customer shall be considered invalid and shall have no effect.
Biella Scarpe spa shall send the Customer a communication by e-mail stating the non-acceptance of the order proposal and the non-conclusion of the contract, also taking care of the cancellation of any charges and/or expenses to be borne by the Customer.
It is possible that occasional non-availability of the Products offered may occur. In this case, Biella Scarpe spa reserves the right to partially fulfil the order. In such a case, only the amount corresponding to the partially fulfilled order shall be debited.
The order sent by the Customer has the value of a contractual proposal and implies the full knowledge and acceptance of these General Conditions.

6. Methods of payment
he Customer may pay the price of the Products and the relevant delivery costs by Credit Card, PayPal, Scalapay, Satispay, Klarna or cash on delivery only for shipments to Italy; in the latter case, since it is a special delivery method, a surcharge of € 4.00 is required, which must be paid directly into the hands of the courier (only for shipments within italy).
Biella Scarpe spa accepts payments made with credit cards of the Visa/Visa Electron, Master Card, Poste Pay and American Express circuits.
Credit Card payments are charged to the customer at the time of order completion (direct accounting); if for any reason the product is no longer available, the amount will be refunded to the customer.
If, for any reason whatsoever, it proves to be impossible to debit the amounts due by the Customer, the purchase process will be automatically cancelled and the purchase will be cancelled.
Biella Scarpe spa accepts payments made with credit cards of the Visa/Visa Electron, Master Card, Poste Pay and American Express circuits.
Credit Card payments are charged to the customer at the time of order completion (direct accounting); if for any reason the product is no longer available, the amount will be refunded to the customer.
If, for any reason whatsoever, it proves to be impossible to debit the amounts due by the Customer, the purchase process will be automatically cancelled and the purchase will be cancelled.
7. Transport, delivery and shipping costs
The Products purchased on the Website will be delivered to the address indicated by the Customer.
No deliveries will be made to post mailboxes.
Delivery costs are free of charge on orders above or equal to €49 (shipment to Italy) or £ 99 (shipment to UK); for orders below €49 delivery costs are €5.90 and are shown on the order form; for expenses of less than £ 99 the delivery costs are quantified in £ 12 and highlighted on the order form. For urgent orders within Italy, you can select Express Shipping at an additional cost of €5.00, which guarantees priority processing of your order.
All purchases will be delivered by DHL Corriere Espresso, TNT, FEDEX or BRT. As mentioned in art. 6, cash on delivery is a special delivery method only for shipments in Italiy for which a surcharge of €4.00 is required, which must be paid directly into the hands of the courier (only in Italy).
With the exception of cases of force majeure or unforeseeable circumstances or other events not attributable to Biella Scarpe spa, the Products shall be delivered within the date indicated in the Product sheet or in the shopping cart procedure, where provided for, or otherwise at the latest within thirty days from the date of conclusion of the contract.
n the event that the Customer uses the forwarding agents appointed by Biella Scarpe spa, the risk of loss of the Products shall be borne exclusively by Biella Scarpe spa, except for the fault and/or responsibility of the forwarding agents themselves towards whom we reserve the right of recourse.
Instead, the risk of loss is transferred to the Customer if the latter chooses a courier different from those offered by Biella Scarpe spa. The same risk of loss is charged to the Customer also in case of sending of the Products for return made in the exercise of the right of withdrawal (if the Customer is a Consumer), without prejudice to their rights towards the carrier in charge of the return shipment.
NIf the Customer finds any damage to the packaging or wrapping at the time of delivery by the carrier/freight forwarder, they shall immediately report the fact by affixing a "reservation" on the delivery receipt, since they are otherwise precluded from any subsequent exception regarding the external characteristics of the goods delivered.
A similar reservation shall be made every time the Customer wishes to reserve the right to analyse the product delivered by the carrier/freight forwarder in greater detail, as the Customer is likewise precluded from making subsequent claims if a more detailed examination of the goods delivered reveals that they are damaged due to an act or fact attributable to the carrier/freight forwarder.

8. Right of withdrawal - Information
If the Customer is a Consumer (i.e. a natural person who purchases the Products for purposes other than his/her own commercial, artisan, entrepreneurial or professional activity), they are entitled to withdraw from the contract, without giving any reason, within 14 (fourteen) days from the date on which, even through a designated third party other than the carrier, obtain the physical possession of the Products or, in the case of a contract relating to multiple goods ordered in a single order and delivered separately, from the day on which the Customer or a third party other than the carrier and designated by the latter, obtains physical possession of the last good.
In order to exercise the right of withdrawal, it is necessary to inform Biella Scarpe spa of the decision to withdraw from the contract, by submitting an explicit statement (e.g. letter sent by mail, fax or e-mail) or by using the standard withdrawal form attached to Legislative Decree 21 February 2014 n.21 (Annex I, part B).
The notice shall contain:
(a) the explicit manifestation of the decision to withdraw from the contract;
(b) the progressive order number communicated by Biella Scarpe spa at the time of the purchase confirmation;
(c) the unambiguous indication of the Products for which the right of withdrawal is to be applied, with specification of the article code, number/size;

In order to comply with the withdrawal period, it is sufficient to send the communication before the expiration of the withdrawal time limit. The Products shall be returned or delivered to Biella Scarpe spa at the above mentioned address without undue delay and in any case within 14 (fourteen) days from the day in which the withdrawal from the contract was communicated.
The deadline is met if the Customer returns the Products before the expiry of the period of 14 (fourteen) days. The costs of returning the Products shall be borne by the Customer.
For the return of the Products shipped in Italy, the Customer can also make use of the collection service by express courier TNT, BRT, FEDEX, SDA, or DHL organised by Biella Scarpe spa. The service must be booked by contacting Biella Scarpe spa at the e-mail address ecommerce@contescarpemoda.it specifying the date and address where the products will be collected.
The cost of the collection service is €8.00 for Italy.
The amount of the collection service will be retained at the time of the refund.
The service is only available for collection in the Italian territory and the choice of courier is made exclusively by Biella Scarpe spa.
The products must be returned or delivered in their original packaging, intact, unused, unworn, unwashed, undamaged and accompanied by the identification tag or label or seal attached.
Biella Scarpe spa will not be able to accept the return if these conditions are not correctly respected and if the label or the sticker or the seal are not intact and attached to the Products. In particular, the Products must not show any obvious signs of use, other than those compatible with the performance of a normal test of the article, i.e. they must not bear any traces of prolonged use (more than a few minutes) exceeding the time necessary for a test and must not be in such a state as to prevent their resale.
Furthermore, the Customer may not exercise the right of withdrawal in the case of personalised products or sealed products that are unsuitable for return for reasons of hygiene or health protection and that have been opened after delivery.
After verifying the correct execution of the above terms and conditions, Biella Scarpe spa shall send, by e-mail, the relevant confirmation of acceptance of the returned Products and shall activate the procedure for the reimbursement of all payments received from the Customer, including delivery costs, (with the exception of the additional costs deriving from the possible choice of a type of delivery different from the least expensive type of standard delivery offered by Biella Scarpe spa), without undue delay and in any case within (14) fourteen days from the day in which it has been informed of the Customer's decision to withdraw from the contract and once it has verified that the withdrawal has taken place in accordance with the above conditions.
The refund shall be made using the same means of payment used by the Customer for the initial transaction, unless otherwise agreed with the Customer, who shall not incur any cost as a consequence of such refund.
For purchases made with cash on delivery, Biella Scarpe spa shall proceed with the refund by bank transfer.
The actual time for the re-credit or refund of the amounts depends on the payment method used.
The refund may be suspended until Biella Scarpe spa has received the Products or until the Customer has demonstrated that he/she has returned the goods, according to which situation occurs first.
The refund will also be confirmed by email.
If the terms and conditions for the exercise of the right of withdrawal are not respected, there will be no right to the reimbursement of the sums already paid.
The non-acceptance of the return will be communicated to the Customer by Biella Scarpe spa, via email, in the same way and within the terms described above for the acceptance.
The Customer may however re-obtain, at their own expense, the Products in the condition in which they were returned to Biella Scarpe spa. Biella Scarpe spa shall not be liable for reimbursement or compensation for Products shipped but never received by Biella Scarpe spa due to loss, theft or damage not attributable to Biella Scarpe spa.
The Customer shall be liable for any decrease in the value of the Products resulting from handling other than that necessary to establish their nature, characteristics and functioning.
In order to exercise the right of withdrawal, it is necessary to inform Biella Scarpe spa of the decision to withdraw from the contract, by submitting an explicit statement (e.g. letter sent by mail, fax or e-mail) or by using the standard withdrawal form attached to Legislative Decree 21 February 2014 n.21 (Annex I, part B).
